Trade mark infringement
Stewart Plastics Limited is a long established manufacturer and supplier of garden products. Following the discovery that a rival was using a photograph of one of its seed trays embossed with the Stewart Plastics trade mark and a photograph of its gravel tray to market its own products, asb law was instructed to take action for trademark infringement which resulted in Stewart Plastics receiving an account of profits and costs.
We have also advised on trade mark applications, a claim to ownership of injection moulding equipment that had been in Stewart’s possession for a number of decades, patent licenses and royalty agreements and the enforcement of non-compete provisions in exclusive distribution agreements.
